Former President Trump’s legal counsel told the Mark Levin Show that he is preparing to file a Fourth Amendment lawsuit “very soon” against the Justice Department in connection with the Mar-a-Lago raid. James Trusty, a former federal prosecutor, said Trump’s legal team would “weigh in very hard and very hard,” saying they would “attack” the search warrant used in the FBI raid on the former president’s Florida estate. . “It would have to be something that would be made public. So all of the United States would be able to read this,” Trustee said of the former president’s action. As for the timing of the move, Trusty said Monday is a “possibility,” but added “it will probably be more like hours.” “It’s coming very soon,” he said. And keep in mind, all we’ve seen is a warrant and an inventory. But the warrant has language in it for if you find a classified document, you can get the whole box, that and you can get all the boxes near it. And that’s really the functional equivalent of a blanket search. There’s just no limit to that scope of the warrant,” he said Trustee on the Mark Levin Show. Trustee said Trump is “entitled” to a specific inventory list of what was taken from Mar-a-Lago and went on to say that the proof of ownership, which was released, is a “very vague document.” “We’re way behind the government playing fair and giving us the details we’re entitled to,” Trusty said. He called it “complicated” that FBI agents seized items such as privileged attorney-client information and passports belonging to the former president. FBI agents executed a search warrant at Trump’s Florida estate on August 8 and seized items, including 11 sets of material listed as classified, as well as some classified as top secret. Trump has denied that any of the materials in his possession at Mar-a-Lago were classified. He said it was “strange territory” and said it was “worrying territory in terms of historical precedent,” also stating that there are large volumes of documents that have been obtained and are subject to privilege. “We believe there is a legitimately large body of potentially privileged documents, and we’re not willing to just take it on faith,” Trusty said.
