The family of late actor Bill Paxton has reached a settlement in their wrongful death lawsuit. According to court documents obtained by People, the attorneys filed a notice of settlement Friday in Los Angeles Superior Court. the settlement reportedly still awaits judge approval. Paxton, known for his roles in “Aliens” and HBO’s “Big Love,” died in 2017 at the age of 61 after suffering a fatal stroke due to complications from heart surgery. The lawsuit was filed in 2018 by Paxton’s widow, Louise Paxton, and their children, James and Lydia, accusing surgeon Dr. Ali Khoynezhad and Cedars-Sinai Medical Center of Los Angeles for providing “negligent diagnosis, management and treatment.” According to the lawsuit, the hospital “delivered and/or withheld information about the risks of the surgery and the care to be provided and/or did not adequately explain the proposed treatment or procedure.” Paxton had undergone surgery to replace a heart valve and repair an aortic aneurysm. READ MORE: Bill Paxton’s family sues LA hospital and surgeon for wrongful death The suit also alleged that Cedars-Sinai “failed to disclose this [Dr. Khoynezhad] he was going to use a high-risk and unconventional surgical approach with which he had no experience and which, based on information and belief, was beyond his scope of privilege.” Additionally, the lawsuit alleged that Dr. Khoynezhad “was not at the hospital” when Paxton “began to suffer the complications” and had neglected to arrange for “continuing care and coverage” during his absence from the hospital, resulting in “delay in treatment leading to damage”. “Bill Paxton and his family trusted the doctors and staff at this medical facility, but instead Cedars-Sinai betrayed their trust,” the family’s attorney, Bruce Broillet, said in a statement at the time. “The surgeon’s actions resulted in this tragic and preventable death.” READ MORE: Celebrities share touching tributes to late Bill Paxton after his death at 61 Steve Heimberg, another attorney representing the Paxton family, previously revealed that Dr. Khoynezhad resigned from his position at Cedars-Sinai shortly after Paxton’s death. Paxton’s family had previously settled partially for $1 million with the General Anesthesia Specialists Partnership, the agency involved in his surgery. While the partnership denied any liability for Paxton’s death, the agreement was reached “to reasonably compensate the plaintiffs and avoid exposing the defendant to a costly and time-consuming legal process.”
